We sail regularly at the open ocean 800+m out. No one was ever checked.
I don't think they would bother for a kilometer out.
People generally wear a life jacket for safety and easier waterstarting.
I am coming to your shores from October to early December. How strict are these safety rules, are people been stopped and checked while windsurfing ?

If you sail the river, the regulations don't apply there. Ocean areas they do. But as others said you pretty much have to be in the right spot at the wrong time. They target safety bay on occasion as they have to do rescues down there a bit (not generally water sports related, usually terry tourist wading across to the island on the sand bar losing their way) so it gets some attention.
generally speaking, the further away from Perth you are, the less likely you'll come across them.
To add, wear the buoyancy vest at least. If they happen to be about and notice you're not wearing that, more than likely they'll stop for a "chat".
How does a shore observer prove how far out you were? And which of the sail thingies that look the same was you?
