Neil Scheltema hit by speed boat

When I had a bad ankle break I was sent to a physio who gave me brute force exercises that hurt.
I went to my chiro who gave me DNS exercises . They seemed too simple but gave the same results with no pain.
I got back into windsurfing after 6months ( flatwater). I was hobbling around on the land but I could sail. I was getting some sharp pains at times. The chiro said that was good as it was breaking up the scar tissue and realigning it as needed.
A few years on and I hardly notice the ankle. It gives the occasional sqwark.. I do work at it with ongoing stretches and keeping fit.
Mine wasn't as bad as yours but a year or so later my chiro admitted she is amazed at what I am doing and that the ankle was " ugly".

Why have I been a chiropractor for 20 years? Because it is rewarding helping people who then refer their friends to be helped. Maybe you met the wrong chiro.

I phoned today Marine Department to find out when my Report will be finalised.

It is now complete and the Report was read out to me over the phone.

It is not good despite the obvious evidence and should send a CLEAR message to other windsurfers - if you get struck by a boat whilst sailing a finding of guilt against the person navigating the boat is very unlikely short of supporting video evidence and / or eyewitness testimony.

I rang 6 months ago the person who I had the collision with. He said he was travelling to Bicton from Pelican Point. For those who do not know the river this direction is roughly towards Fremantle coming from Perth.

I was sailing that day ONLY across the river,roughly in a perpendicular or 90 degree direction to the boat. I mentioned this in my statement.

I have two other witnesses that said I was travelling in this direction. One of the sailors who I just spoke to said he saw me perhaps 20 seconds or so before the accident.

It is also worth adding I had no access to the statement of the boat owner before writing my statement. nor did anyone else.

The damage to my board is entirely not consistent with a parallel collision of up to 22.5 degrees

A parallel collision of say two cars up to 22.5 degrees would result in damage that is NOT DEEP or severe rather the damage would be shallow - more dent like. The same can be said of a boat and a windsurfer travelling side to side up to 22.5 degrees.

I will post close up pics of my board on here soon.

When all is done and said any financial compensation is secondary to the ongoing safety of other windsurfers when sailing in the vicinity of boats. At least having two accidents so close together has made it crystal clear to all windsurfers to the dangers of boats. The last thing they are looking out for are windsurfers and these two accidents are not going to change this one iota.

It seems boat owners can mow windsurfers down and short of there being video footage and / or other eyewitness account to the accident NO finding of guilt is likely to be made by the Government Body.

That sucks.

We have a windsurfer at our local spot who is well known for his aggressive sailing. He has gotten yelled at many times by various people at most spots he has ever sailed. Recently, he jibed straight into another guy he had just passed, damaging his board. He then yelled at the guy he had hit, asserting that he had the right of way because he "jibed there the whole day" and because he was on starboard. He gets quite loud and insulting to anyone who disagrees with him. I actually started using my helmet cam again after this incident, specifically so that I would have video footage in case I'd find myself in the same situation. A bit like needing a dashboard cam when driving in Russia.

Why are you relying on the finding by a government body? take legal action


Actually Choco has a point. Have you spoken to a solicitor, asking them if you can recover your financial losses from the boat captain, regardless of what the report says?

It may not change anything with regards to how boaties behave, but if there is a good chance of you recovering your costs, then it might be worth chasing up.

No win no fee solicitor will take it on board if there is a likely hood of damages being awarded, they will chase the boat owners insurance most likely. Worth a phone call
