That case would have to be why liayars receive such a bad reputation when this type of thing is progressed so high in the lands legal system.
Would have to be some prize wally this lad

Mineral, it is an 8,000 million dollar handout. It makes sense to check if it is legal. The lawyers/High Court fees would be insignificant in the greater scheme of things.

The process is important otherwise you have scenarios such as one man taking a democratic country to war without any discussion or vote in Parliment or even Cabinet.

Yep your right if we didn’t have a Westminster system , however we have two houses of parliament and a whole team of l lawyers working for them before the stimulus package was approved and passed by both houses. The clown was either just grandstanding or had an ulterior motive

I think if you read it closely, the point was not ever about the payments (he pointed out other "legal" ways for the payment to proceed), it was about the legality of whether it was a tax benefit or a gift.
The ATO cannot give you a gift.

There still may be ramifications, because it highlighted the fact that the Commonwealth is actually overstepping its authority, constantly.
I'm not an expert and only listened briefly on the radio, but if you check the constitution etc. apparently the States are supposed to hold most of the power and the commonwealth just binds a few things together, over the years that seems to be being reversed.

Grumps , I agree with you here.

Unfortunately the High Court does not seem to restrict itself to matters of law. Unlike the Privy Council which being UK based and was sort of an unbiased umpire the guys in the High Court seem to vote along the lines of the political masters who installed them there. See the Corporations Law decision and their absurd reasons/findings.
