Hi,
I'm travelling to Maui in July and wanted to take out travel insurance that actually covered me for 3rd party liability when windsurfing.
When I was there last year I met a lady who's husband was being spoken to by the police re; damaged equipment and injury to a Maui resident in a collision at Kihei. Wasn't pretty.
So, does anyone know of any policies that address liability whilst on the water?
All I find in every PDS is the following statement;
We will not pay for;
"liability arising out of the use or ownership by You of any aircraft, drone, firearm, waterborne craft or mechanically propelled vehicle".
Any advice?
Any good policies out there?
David
I was thinking the AWA policy may cover it, but looks like USA/Canada are excluded: ![]()
awa.pscinsurance.com.au/
What is Covered
The insurer will indemnify the Insured for the Insured's legal liability to pay compensation in respect of: a) Injury, and/or b) Damage, and/or c) Advertising Injury
Happening anywhere in the world excluding USA and Canada during the Period of Insurance as a result of an Occurrence in connection with the Sport.
The insurer will also pay the Defence Costs incurred with the insurer's prior written consent In the defence, settlement or investigation of any claim covered. These covers are subject to the conditions and exclusions included in the policy wording and schedule of cover.
When I went last year my travel insurance covered 3rd party liability, went through a few companies before I (my wife) found the one we used, will ask in the morning if she can find the details.
Interesting, I'm going in June and got travel insurance with Covermore, I asked about windsurfing but hadn't considered 3rd party liability.
Now I need to ring and ask that question .
From page 49 of the Covermore PDS:
"Personal Liability
We will not pay for : ...
4. liability arising out of the use or ownership by You of any aircraft, drone, firearm, waterborne craft or mechanically propelled vehicle."
I've had good experiences claiming on Covermore policies, once from an injury in Maui to myself, but it clearly doesn't cover you for 3rd party liability arising from use of a sailboard. Hawaii has some weird liability laws that I tried to get my head around (I'm not a P.I. lawyer), but I gave up in the end.
I rang Covermore and they said I am not covered if it's a rental board. If it was my own board I would be. This seems to conflict with what Mikey has found and quoted above. I would trust more what he found then what Covermore told me.
I saw on the board hire places in Maui you can take out insurance for $8 a day more. Possibly this insurance covers third party liability?
it gives me a question to ask them.
Shame I didn't see this post before I bought our travel insurance but glad to be aware of the issue.

When I took out the insurance from second wind, going from memory, the policy was void if you were in any collusion, even if it was the other persons fault. I pretty much took it as insurance for kit only
i tried to take up the insurance with Matt Prichard but it wasn't an option.
