Mark Rounding

Hey I'm training with my friend for some regatta's this season.
So far so good, we can both plane, gybe and tack but we come into an argument when it comes to mark roundings, I will go through the situation just to be clear. We both ride ozone edges, I have an 8m and he has a 10, we both use old boards just to practice, intending to buy better ones once we have some pace. We are both fully aware of the basic sailing rules (both competed in sabot nationals, 29rs, lasers etc.

Anyways, we were both coming up to the top mark, I am below him pushing him up as I had the rights. I lower my kite down ready for the rounding, only to see his kite go straight to 12. I look back to see what he intends to do, only for him to boost over the top of me and the mark, doing a down-loop to land smoothly.

Now we both know who had rights etc. but are you allowed to do this provided there is no collision? what rights do you have boosting over marks and other riders?

There's a special section of the rules of sailing talking about kiteboarding..

In fairly sure it specifically says that u lose any rights if you jump or if looping the kite.. So in a collision he would likely be in the wrong..

Rule 22.4 and 22.5.

A kiteboard that is jumping shall keep clear of one that is not.

When sailing downwind, if one kiteboard is looping her kite and another is not, the kiteboard that is looping her kite shall keep clear of the one that is not

So to be clear, if I was ahead, no one around, I could jump the mark and it counts as rounding?
If so at what point does rounding the mark become underlaying the mark?

Provided you complete a rounding manoeuvre I'm sure no one is going to stop you, jumping it.. I had a brief argument with the R/O about when I stacked it at the top mark and my board rounded the mark and I body dragged under it..

Be mindful thou that typically there's a trailing bouy at the top mark so you wouldn't want to crash into the rope for that..
