Speeding fine - should I pay?

I have 40 years without an infringement, I had to merge as my lane was ending (this is clearly shown in the speed camera shot in a school zone) .
My defence is - while merging it is not safe to monitor a speedo and safe merging may require a short need to accelerate.
The camera's photo has no pedestrians anywhere.
I have sent in a request for liency under the 10 year with no penalty but rejected so did again only to receive in the mail a final notice to pay.
I phoned and was advised school zone so no excuses.
A lawyer advised going to court would cost $600 upwards plus lawyer.
The fine is $190 and 2 points for 10 kph over limit.
What a fair and just system.

I just used the 10 year/good behavior option, and I noted that they don't allow for it in school zones or drinking offences.

I guess you are out of luck.

You were speeding. You got caught... too bad... pay the fine... that IS fair... move on...

I agree with you, but having gone to court to prove my case I can give you the benefit of my experience.
Pay the fine and don't tell anybody about it.

1.- The court is not interested in any of your excuses even if the measurement was COMPLETELY at odds with the NSW police manual, from a distance and an angle. You can't question any aspect of it. Don't care if the difference between you losing your license and not is the LiDARs margin of error.

2.- Don't tell anybody, bcos nobody cares about your excuse, well maybe your immediate family, but no one else. You're wrong and it doesn't matter if you are a safe driver, never had an accident, never drink & drive and suddenly you get a speeding ticket of a speed you know you weren't doing. You're wrong and you'll need to go to the Supreme court to prove you're right... $150k + 2 years of your life + 5 years from stress.

3.- Your friends and family might tell you to fight it, write letters, go to court... don't listen they're full of crap and when you lose they'll say I told you no to.

Trust me when I say paying it is the easiest thing to do. The world isn't fair and Australia w/ drivers is like Malaysia w/ drug dealers, 0 tolerance.

PS: Your excuse is totally crap too, and I guarantee you that a court will increase the fine to $2500 + court costs + victim support levy.

You can take it to court but odds on you'll lose it and you'll turn that 40 years without a ticket into your first court conviction.

My mum was the same, boasting about her perfect record, she go pinged, took it to court and lost. I'm waiting for the right time to highlight she's now the only one in the family with a court conviction

Why do people spend so much time arguing about speeding fines? Seems to be a national past time. Count yourself lucky for all the times you've sped and not been caught.

There is another solution which worked for me just recently. Drove Uber in Brisbane for six months and ran up four speeding fines and two infringements. Have had a clean license for over thirty years, pretty much as a result of good luck but the mania for regulation combined with an average of 2000ks a week around Brisbane finally caught up with me.

So I moved back to Coffs Harbour and changed my licence back to NSW. Whilst in Roads and Maritime or whatever they call it now I asked whether the loss of points would be transferred. The reply was only if it was serious.

So back onto 12 points and I have no intention of paying any of them either.

^^^ That'll only work if you never go back to Qld, here in WA if you tried that your unpaid/ignored fines eventually end up with an arrest warrant being issued.

I take it you lost all your points and your license? I can understand how the court might not looks so favourably on that proven track record

also, the state of W.A. has number plate recognition cameras fitted to police cars - and so does the sheriffs office.

Unpaid fines can lead to your license being cancelled, and your vehicles being seized and sold.

The insanity defence is a desperate and risky one to make. Even if it works for this the state can, and most likely would lock you up indefinitely on mental health grounds anyway.

You committed the crime, now its time to pay

That is a poor defense, not knowing your speed / being able to watch your speedo?1! is poor, you may need to accelerate, you could also deaccelerate

You were at least 20% over the speed limit, so not speeding by a little....

Speeding in a school zone is a no no you know it, we all know it

What's wrong with kids today? Can't they just stay on the footpath?

It's not about ways to get out of speeding fines, but a thought occurred to me on how to get out of life jacket fines. It's illegal to be on a private boat without wearing one, but it is perfectly legal to go swimming without one.....Soooooo.... jump overboard when you get caught. What are they going to do if you just happened to be on the boat between dips?
