Hi to all the local WA fishos out there did any of you guys out there know that the RAC has bought the lease on the caravan park in Cervantes WA and are wanting to kick all the onsite caravan owners out of thier vans which means I lose my fishing spot and my little piece of paradise along with 68 other van owners To see more please go to FACEBOOK Save Cervantes as you know it and have a look around and jion the group and follow the link to vote because we the van owners need a lot of help to beat the RAC

Yes, I'm aware of it. I stop in there from time to time.

The problem is, and always is, when you rent anything off a private enterprise you only have security of tenure for as long as the agreement is written for.
With caravan parks, this is usually around one year, and the agreement is renewed each year.
Holiday parks might have some longer period, but even then, you still do not have permanent tenure.

And in this case, it appears there was never any long term security of tenure promised by either the previous owner or the present owner, (now RAC).

It's a bit rude but the reality is, neither the previous owners nor the present owners were in the business of providing social services.
The rental agreements were always on a temporary basis and the present tenants are now finding out the downside of that.

To get anywhere with your complaint you would have to show where there was some previous agreement that your tenancy was to be on a perpetual basis, and that is highly unlikely.

It's not the first time that this sort of thing comes up, and the outcome is usually that the renter has no case to pursue through the courts.

I might point out that the park owners were probably not the recipient of the large sums paid by the people holding the present temporary rental agreements.
That profit was made by the many previous tenants.

I might also say,.. that's why I would never pay more than a few thousand dollars for a site in a caravan park. It's just too much of a risk.

What has the RAC got to do with caravan parks? Apart from a tenuous link to travel for their members, it is an investment decision. A WA business that had its roots in WA car enthusiasts (who may tow caravans to places...?) is now sh!tting on the little guy to make money.
Like Wesfarmers eventually becoming so big it works against its grass roots constituency.
That's really sad. Walmart of the West...

Also, for many decades you could hold an onsite van and not be kicked out - this seems to be a relatively recent phenomena. I'd argue there was a reasonable expectation of the ability to holiday there for years to come like previous generations did. So at least if they wanna change it there needs to be a long grace period or a damn fine buy-out figure.

I blame onsite vans for the spread of Ground Asparagus, the scourge of the East Coast.

The price reflects the risk. If there was a guarantee of secure tenure, they'd be way more expensive.

I don't understand where people think they have the right to protest and lobby in this type of situation. What's the difference between living in a caravan park and not having your lease renewed and living in a private rental and not having your lease renewed? Nothing, except perhaps those in a private rental are a bit more realistic about the situation overall. By their very nature and definition caravan parks are a transient thing, people putting down roots and thinking thry are entitled to stay there forever bewilders me.

There is a big difference, those who bought in to a semi permanent lease would most probably parted with a considerable amount of money for an old van on a slab. It isn't like they are staying there for nothing, the semi permanent lease only comes with so many days per year included in the price. Any days you choose to stay there over and above this , you have to pay for .

I camp up there at least twice a season and used to enjoy walking past the old vans for sale and checking out the asking price of the ones up for sale, they weren't cheap , that's for sure . Personally , i don't think its good for anyone when they get chucked out. Making the lease non transferable would be a better way to go about it . J

^^ agreed..... it is not a residential tenancy.
This is sort of like booking into a hotel and then when u arrive they say, nah changed me mind mate. Bye

But are they looking to do anything outside the lease agreement? At the end of the day it's still a lease, not freehold or green title. Caravan park sites have been sold off to developers for as long as I can remember, it's nothing new, nor should it come as a surprise.
